1. Our Ownership and Protected Assets

A. Protected Assets

All content appearing on our website, including unique product designs, logos, code, text, and the trade name Attegy, is our exclusive intellectual property and is protected by U.S. and international law.

B. User-Submitted Content and Liability

As we operate an on-demand printing platform, any text or graphics (e.g., Custom Name submissions) provided by a customer are strictly subject to the following terms:

  1. Warranty of Legal Use: By submitting content to us, you warrant that you are the rightful owner of the content or have secured all necessary rights, licenses, and permissions for us to print that content for you.
  2. Indemnification: You agree to indemnify and hold harmless Attegy from any damages, liabilities, and legal costs arising from any intellectual property infringement claim related to the content you provided.

2. Submitting an Infringement Notice

If you are the intellectual property owner (or an authorized agent) and believe your rights have been violated by any material on our site, please submit a formal notification to our support department via email.

A valid Infringement Notice must include all of the following elements:

3. Actions Following Claim Receipt

A. Takedown and Review

Upon receipt of a complete notice, we will:

  • Temporarily remove or disable the allegedly infringing content immediately.
  • Initiate an internal review process and will respond within 5 business days.
  • If infringement is confirmed, the content will be permanently removed from our platform.

B. Repeat Infringer Policy

We maintain a zero-tolerance policy for users who repeatedly violate intellectual property rights. We reserve the right to suspend or permanently terminate the accounts of any user found to be repeatedly uploading or selling infringing content.

C. Misuse of the Process

Knowingly submitting fraudulent or false infringement notices may subject the sender to liability under Section 512(f) of the DMCA and may result in liability for damages and legal fees. Please ensure all claims are truthful and legally founded.

4. Counter-Notice Procedure

If your content was removed due to mistake or misidentification, you have the right to submit a Counter-Notice under the DMCA. This must be submitted in writing and include:

  1. Identification of the material that was removed and its location (URL) before it was removed.
  2. Your name, address, and telephone number.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Consent to the jurisdiction of a U.S. Federal Court in the judicial district where your address is located.

We will forward your Counter-Notice to the original complainant. If they do not inform us that they have filed a court action within 14 business days, your content may be restored.
